Organizational Conflict: Meaning, Sources, Types And Conflict Management




Meaning of Conflict
Disagreement between individuals or groups within an organization, that may have an impact on the overall functioning of the organization.
According to J. W.Thomas
“Conflict is a process that begins when one party perceives that another party has negatively affected, or about to negatively affect, something that the first party cares about.” 

Nature of Conflict
•      Conflict is different from competition.
•      Conflict occurs when two or more parties pursue two or more mutually exclusive goals.
•      Conflict arises out of two perceptions.

CHANGING VIEW OF CONFLICT
Ø Traditional view
  • Conflict is avoidable.
  • Conflict caused by management error in designing organization.
  • The task of management is to eliminate conflict.
  • Optimal organizational performance requires the removal conflict.

Ø Modern View
§  Conflict is inevitable.
Conflict arises from many causes including organizational structure, unavoidable    differences in goals, differences in perception.
§  The task of management is to manage the level of conflict and its resolution.
§  Optimal organizational performance requires a moderate level of conflict.

Types of Conflict
Based On Content-
1.      Task Conflict- This type of conflict occur due to conflict over content and goals of work.
2.      Relationship Conflict- It is based on interpersonal relationship of employee.
3.      Process conflict- This type of conflict occur due to differences between how work gets done, what is the procedure for doing work, which type of process to be use.

On The Basis Of Impact-
1.      Functional conflict- It has a positive impact in the organization.
2.      Dysfunctional conflict- It has a negative impact in the organization.

On The Basis Of Level-
In 1957, Kenneth W. Thomas classify the conflict as-
1.      Individual level
2.      Group level
3.      Organizational level


Sources Of Conflict
1.      Intra –Personal Conflict
2.      Inter- personal Conflict
3.      Inter- Group Conflict
      The reasons for inter group conflict are many, such as:
•      Task Interdependence
•      Task Ambiguity
•      Goal incompatibility
•      Competition for limited resources
•      Competitive reward system

Process Of Conflict- It is given by Pandy. According to him there are 5 stages of conflict, which is given below-
1.      Latent conflict- It is not apparent not aware. It may occur in subconscious mind.
2.      Perceived Conflict- In this stage conflict exist because of misunderstandings between parties or employees and also due to low communication between them.
3.      Felt Conflict- In this stage conflict is felt by a person. They feel stress and anxiety.
4.      Manifest conflict- In this stage conflict is open and observed by the other people. In that stage people behave aggressively.
5.      Conflict Aftermath- It define outcome of conflict.



Conflict Management-
Conflict management is the practice of being able to identify and handle conflicts sensibly, fairly, and efficiently. There is two way by which conflict can be manage, they are:
1.      Stimulation of functional conflict.
2.      Resolution of dysfunctional conflict.

Conflict Management Styles
•      Accommodating –One party surrenders its need and wishes to accommodate the other party.
•      Avoiding –Avoid or postpone by ignoring or changing the subject.
•      Collaborating- win win situation for both parties.
•      Competing-Competition between parties.
•   Compromising- In this method both parties compromise from there side, in a simple word find a middle ground.

CONCLUSION
Individuals should understand their own personal triggers to better deal with conflict situation in the work place. Group members should think about other group member early on to identify privately those individual and behaviors that may push their buttons.

Gratuity: Rules, Applicability, Payment, Penalities




Gratuity is a statutory benefit paid to the employees who have rendered continuous service for at least five years. It is a lump sum amount paid to an employee based on the duration of his total service. The benefit gratuity is payable to an employee on cessation of employment (either by resignation, death, retirement or termination, etc) by taking the last drawn salary as the basis for the calculation. Gratuity is an important form of social security and is in the form of a gratitude provided by the employer to the employees in monetary terms for the services rendered by them to the organization. It is a defined benefit plan and is one of the many retirement benefits offered by the employer to the employee upon leaving his job. Gratuity payment liability of the employer tends to increase with an increase in the salary and tenure of employment. 

Payment of Gratuity Act, 1972 
21ST August, Came into force w.e.f. 16th September 1972.
Applicability of The Act
As per the Gratuity Act, the scheme for the payment of gratuity is available to:
¨      Firstly he should be employed in an establishment to which Act applied according to sec1(3)
·         Every factory, mine, oilfield, plantation, port, railway company
·         Every establishment within the meaning of any law, force in relation to shops and establishments in a State, in which 10 or more persons are employed, or were employed, on any day of the preceding  12 months;
·          as per the notification of Central Government in this behalf.
·         Not apply in J&K pants and mines.
¨      Secondly he should be employee under Section 2(e)
Employee means any person (other than an apprentice)  employed on wages in an establishment to do any skilled, semiskilled,  unskilled, manual or  supervisory, technical, or clerical work.

When Is Gratuity Payable
•      According to section 4(1) of the Payment of Gratuity Act, 1972 gratuity is paid after termination of employee after rendering continuous service not less then 5 years:
                (a) on his superannuation,
                (b) on his retirement or resignation or,
                (c) on his death or disablement due to accident or disease.

Who should get if employee dies
In the case of death of the employee,
*      Gratuity payable to him shall be paid to his nominee or,
*       if no nomination has been made, to his heirs, and
*      where any such nominees or heirs is a minor,
*      the share of such minor shall be deposited with the controlling authority (i.e. government officer) who shall invest the same for the benefit of such minor in such bank or other financial institution, as may be prescribed, until such minor attains majority.

Amount Of Gratuity Payable
•      Basic pay is divided by 26. The amount so obtained is multiplied by 15 to compute the amount of gratuity  per year.
•      Maximum Gratuity Payable under Act was Rs. 10,00,000/-
•      Now maximum Gratuity Payable under Act was Rs.20,00,000/- ( w.e.f. 29 March 2018)


Time Limit For Payment Of Gratuity
•      The employer shall arrange to pay the amount of gratuity within 30 days from the date it becomes payable
•      If not paid within the period stipulated above employer is liable to pay interest for the delayed payment
•      Interest is not payable if the delay was caused due to the fault of the employee and
•      the employer has obtained permission in writing from the controlling authority for the delayed payment on this ground
•      If there is any dispute as to the amount payable or the persons eligible to receive it the employer shall deposit amount as per his calculation with the controlling authority.    

Appeal Against The Order Of Controlling Authority
*      Appeal if any shall be made within 60 days from the date of the order
*      Appeal by employer will not be admitted unless the disputed amount is deposited
*      Appellate authority, after giving the parties to the appeal a reasonable opportunity of being heard, Confirm, modify or reverse the decision of the controlling authority 

Penalities
•      Non Payment Of Gratuity
    Imprisoment: 6months -2 years
    Fine : 10,000 to 20,000rs or both
•       Fail In Compulsory Insurance
     Fine : 10,000rs
     For Continuous Offence : 1000rs/Day

MATERNITY BENEFIT




To providing maternity benefit to the female employee Indian govt made an act, which is maternity benefit act.  N.M. joshi is a first person who made effort in 1924 for providing maternity benefit for the employee. Some points of this act are-

 1st MATERNITY BENEFIT ACT IN INDIA
v  Maternity benefit act 1929 (Bombay)
v  Maternity benefit act 1930 (M.P.)
v  Maternity benefit act 1941 (For mines industry)


MATERNITY BENEFIT ACT 1961
Scope Of This Act- every factory, mines, every shop/ establishment where 10 or more people employed or were employed in preceding 12 months.
 WHO CAN TAKE THIS FACILITY
Who work 80 days or more in 12 months immediately preceding the date of her delivery.
 DURATION OF BENEFIT PERIOD
Total duration – 26 week
 Medical bonus- 3500 from dec. 2011
 IN CASE OF MISCARRIGE- leave for 6 weeks
Additional leave for illness due to pregnancy – 1 month
Nursing break- 4 including rest interval
 Employer have to provide creche facility where 50 0r more than 50 employee work and also give the permission to women employee “work from home”.
