MATERNITY BENEFIT




To providing maternity benefit to the female employee Indian govt made an act, which is maternity benefit act.  N.M. joshi is a first person who made effort in 1924 for providing maternity benefit for the employee. Some points of this act are-

 1st MATERNITY BENEFIT ACT IN INDIA
v  Maternity benefit act 1929 (Bombay)
v  Maternity benefit act 1930 (M.P.)
v  Maternity benefit act 1941 (For mines industry)


MATERNITY BENEFIT ACT 1961
Scope Of This Act- every factory, mines, every shop/ establishment where 10 or more people employed or were employed in preceding 12 months.
 WHO CAN TAKE THIS FACILITY
Who work 80 days or more in 12 months immediately preceding the date of her delivery.
 DURATION OF BENEFIT PERIOD
Total duration – 26 week
 Medical bonus- 3500 from dec. 2011
 IN CASE OF MISCARRIGE- leave for 6 weeks
Additional leave for illness due to pregnancy – 1 month
Nursing break- 4 including rest interval
 Employer have to provide creche facility where 50 0r more than 50 employee work and also give the permission to women employee “work from home”.
